The Essential Services Commissioner has approved a transitional version of Information Bulletin #24 concerning Essential Services. This Information Bulletin discusses the responsibilities of parties governed by the essential services Division of the Labour Relations Code and the procedures established by the Commissioner for applications and filings under that Division. Information Bulletin #24: “Essential Services (transitional)” can be found by following this link (ed. Please note one minor amendment at the last paragraph of Section II -- July 5, 2016).

The Board’s Rules of Procedure have been amended to add rules 44 to 47 dealing with essential services applications. In most circumstances, the existing rules of the Board will apply to proceedings by the Commissioner. The amended Rules of Procedure can be found by following this link.

The use of mandatory forms is required for applications for exemptions, replies to applications for exemptions, and to submit an essential services agreement for filing. The mandatory forms for an Application for Exemption, Reply to Application for Exemption, and Joint Submission of Essential Services Agreement for Filing can be found by following these links. Further discussion about the process for submitting an essential services agreement for filing can be found in section VI of Information Bulletin #24.

Amended versions of the Labour Relations Code and the Public Service Employee Relations Act, incorporating amendments dealing with essential services, can be found be following these links.

Information Bulletin #24 and the procedures herein will be reviewed by the Essential Services Commissioner on an ongoing basis, and the Commissioner welcomes comments from stakeholders about these transitional procedures.

Essential Service Agreements

Essential Services Agreements are only in force during the collective bargaining round in which they were entered into, and must be renegotiated or agreed to again for each round. Inclusion of Essential Services Agreements on this list for reference purposes does not necessarily mean the agreement remains in force.

The Commissioner may publish selected essential service agreements on the website for reference by stakeholders. Not all agreements will necessarily be posted here. These copies are for informal reference only, and may not constitute the formal, up-to-date version on file with the Alberta Labour Relations Board.
